Special requirements, conceptual designs certificates
HAKOM defines special requirements for construction which refer to compliance with the provisions of Electronic Communications Act (ECA) and Ordinances. Compliance of the conceptual design with the special requirements shall be determined by inspection of the conceptual design. If the inspection determines that the conceptual design complies with special requirements from Article 106 of the Act on Physical Planning and Construction, HAKOM shall issue a Certificate that the conceptual design is in compliance with our special requirements, so the location permit can be issued. If the inspection determines that the conceptual design does not comply with our special requirements, the aforementioned shall be submitted to the administrative body in writing.
The inspection of the conceptual design can be performed at a conference (on site) convoked by the competent administrative body or at HAKOM, if the competent administrative body submits the conceptual design (that shall be returned with special requirements) or its copy together with the request for special requirements.
When the competent administrative body is the Ministry of Environmental Protection, Physical Planning and Construction (hereinafter: MZOPUG), special requirements and assessment of compliance of the conceptual design are specified in the minutes from the conference. The assessment of the main and conceptual design undergoes the same procedure at the conference in the Ministry.
In the process of issuing special requirements, three types of facilities are distinguished:
- Special requirements for construction of base stations of mobile communications
- Special requirements for construction of residential, office and residential-business buildings
- Special requirements for construction of other facilities (infrastructure)
On average, over 7500 cases of the aforementioned tasks are processed by HAKOM every year.
