Tasks

The tasks of HAKOM concerning postal services refer to:
 
  • public authority transferred to HAKOM by the Republic of Croatia,
  • publication of the postal services providers and
  • other tasks that refer to he guidelines for the effective and efficient work.

 

The Council HAKOM adopts decisions and other administrative acts as public acts in the area of postal services that are final in the administrative procedure and may not be appealed, but administrative proceeding may be initiated before the Administrative Courts which does not delay their putting into force.

The Council of HAKOM-a adopts annual work programme establishing aims and tasks of HAKOM in performing regulatory and other tasks, financial plan and final account and submits to the Croatian Parliament and government the annual work report.
 
 
Public authority
With the objective of efficient postal services market regulation, HAKOM performs the following tasks as the public authority:
  
  • passing of regulations for the implementation of the Postal Services Act,
  • passing and suspending of the decision on determining the universal service provider,
  • passing and suspending of the decision on the performance of replacement postal services,
  • passing of the decision on the accounting separation method for the universal service provider,
  • passing of the decision related to the granting of network access,
  • passing of the decision determining net cost amount which represents unfair burden, the setting up of a compensation fund and determining the contribution to be paid by postal services providers,
  • monitoring and regulation of universal service prices, special prices and general conditions of universal postal service provider in accordance with the provisions of the Postal Services Act,
  • protecting the rights of users of postal services, and settling of disputes between the users and providers of postal services,
  • inspection supervision over the application of the Postal Services Act and regulations adopted pursuant to this Act,
  • keeping and regular updating of databases, registers, records and other data related to postal services and collected by HAKOM pursuant to the provisions of the Postal Services Act and regulations adopted pursuant to this Act,
  • monitoring and analysing the situation and development of the postal services market and undertaking the necessary measures for ensuring fair and efficient competition in the postal services market.

Other tasks
HAKOM performs other tasks in the area of postal services:
 
  • regular publishing of information, notifications and documents related to postal services and in particular market development indicators, in accordance with the provisions of the Postal Services Act and regulations adopted pursuant to this Act,
  • giving expert opinions and explanations on the application of the Postal Services Act and regulations adopted pursuant to this Act,
  • participation in drafting proposals of strategies, studies, guidelines, programmes and implementation plans adopted by the Croatian Government,
  • international cooperation in the area of postal services and participation in the work of administrative and working bodies of the competent European and international organisations and institutions in the area of postal services,
  • cooperation with the competent national regulatory authorities of the EU Member States, the associations of the competent regulatory authorities and national regulatory authorities of other countries in the area of postal services,
  • performance of other tasks determined by the Postal Services Act and the act regulating the electronic communications area, regulations passed on the basis of this Act and the Statute of the Agency.
