New Ordinance on radio equipment published

As of 13 June 2016 radio equipment placed on the market has to comply with the requirements of the new Ordinance on radio equipment.
 
ZAGREB, 31 May 2016. – The new Ordinance on Radio Equipment (Official Gazette No. 49/16) has been published ad it will enter into force on 13 June 2016. This Ordinance replaces the Ordinance on R&TT Equipment. The basic principles of compatibility of radio equipment are similar to the existing ones and the equipment must comply with the requirements of user protection, health protection, EMC, efficient use of the RF spectrum and additional requirements that may be set by the European Commission. Harmonized norms create a precondition of compliance with the basic requirements and the assessment of compatibility consists of the following procedures: internal production control, type examination and complete quality assurance.
 
The Ordinance contains amendments of the scope, that is, the wired telecommunications terminal equipment is no longer covered by the Ordinance, while receivers intended exclusively for the reception of television and radio are covered. Responsibilities and obligations of producers, authorised representatives, importers and distributers have been more clearly defined. Some administrative obligations have been removed thus reducing organization costs. Every economic entity must be able to establish the supplier and buyer of equipment. Manufacturers have been given an additional option to create a simpler EC declaration of conformity. The requirements that must be met by radio equipment include the possibility that mobile phones and other portable devices would have to be compatible and have the same charger.
 
HAKOM will have the same role which includes inspection supervision of equipment that is already on the market. Inspection supervision will continue to be carried out by the competent electronic communications inspector. Safeguard measures are stricter in this new ordinance in compliance with the provisions of the relevant Directive to ensure traceability of equipment in the supply chain, the testing of samples in order to protect security and health of end users and registration of complaints and withdrawal of equipment.
 
The Ordinance was adopted pursuant to the Act on Technical Requirements for Products and the Conformity Assessment by the Ministry of Maritime Affairs, Transport and Infrastructure for the purpose of complete alignment with the provisions of Directive 2014/53/ the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment in the European Union.
