HAKOM: Cancellation of Individual Programmes in VIPnet and B.net Users Packages

ZAGREB, January 5, 2018 – As of January 2, 2018, VIPnet d.o.o. has cancelled the programmes from Discovery's portfolio software found in the basic IPTV service package (Discovery, Animal Planet, TLC, Eurosport 1 and 2). Pursuant to Article 41, paragraph 7 of the Electronic Communications Act (OG 73/08, 90/11, 133/12, 80/13, 71/14 and 72/17), if  the changes are less favourable  in comparison with the general terms of business conditions the end user has right to terminate the subscription contract free of  charge. Furthermore, pursuant to the Terms of Usage of VIP TV Services, Vipnet may change the list of content that will be occasionally published on its web site and / or TV user interface on a timely basis. Vipnet can modify Programme Schedule by excluding some programmes from the package or replacing specific programmes with the new ones.The subscriber will be entitled to terminate the contract regardless of the period of mandatory duration of the contract, i.e. without being charged for the  fee for earlier termination of the contract, in the event of individual subscriber, the significant change of a particular package of the program distributed to the subscriber.

Taking into account the users’ habits in the  IPTV services, each user  who considers  that the cancellation  5 of a contracted programme has been modified to his or her detriment may file a complaint to Vipnet and request the termination of  subscription contract free of charge. In the event of a negative response, users can contact the Croatian Regulatory Authority  for Network Industries (HAKOM) which will define whether he is entitled to change  the package due to  his contractual service and without being charged. Bearing in mind the specificity and market background of this case, HAKOM  cannot prejudge the final position that will be taken regarding the request of each individual user.
