Draft Ordinance on Radio Equipment at Public Consultation

A public consultation has started regarding Draft Ordinance on radio equipment according to which the Croatian legislation is harmonised with the provisions of Directive 2014/53 / EC on radio equipment which shall replace the current Ordinance on Radio and Telecommunications Terminal Equipment (OG 25/12). A public consultation is open until 29 April.

ZAGREB, March 30, 2016 - The Ministry of Maritime Affairs, Transport and Infrastructure opened a consultation with the interested public regarding the Draft Ordinance on radio equipment. Ordinance on radio equipment transfers the Directive 2014/53 / EU of the European Parliament and of the Council of 16 April 2014 into the Croatian legislation on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC

The Directive on Radio and Telecommunications Terminal Equipment (R & TTE) 1999/5 / EC has been in force for over 15 years and in accordance with the development of technology, the EU Parliament and Council revised the Directive and adopted new Directive on radio equipment according to which new regulatory requirements have been developed . Even though the R & TTE Directive will be repealed on12 June 2016 a transitional period of one year is left in which it will be possible to apply each of the Directives, R & TTE Directive, or RED. The manufacturers have been given an additional year to comply with radio equipment requirements of the new Directive.

Some of the changes that the new Directive brings are the following:

It applies only to radio / wireless equipment and does not apply to telecommunications terminal equipment in the fixed network (analogue phones, XDSL terminals, cable and PC modems, etc.). Wired telecommunications terminal equipment will be regulated through the LVD and EMC Directive in the same way as any other general electrical equipment
It applies to the receivers intended exclusively for the reception of TV and radio,
It is clearly defined by the requirement that radio equipment must be constructed in a way that it effectively uses the radio spectrum and supports the efficient use of radio spectrum in order to avoid harmful interference
Clearly defined obligations for manufacturers, authorized representatives, importers and distributors,
Equipment is not marked with the exclamation mark,
The CE marking is not required for users’ documentation
The CE marking and the notified body number is required for Radio equipment only when quality assurance procedure is used
Notified body identification number should not be used with CE marking only when the type- examination is used
"EU Declaration of Conformity contains a number of notified bodies when type- testing and complete quality assurance is used
The radio equipment user’s guide that is transmitting must include a frequency band where the equipment is operating as well the maximum radiated power
The responsibilities of market supervision are clearer and enhanced through the possibilities to supervise economic entities or registration of radio equipment
Notified Body Opinion replaces the Type Examination where the replacement of the products those affecting the compliance must be certified by a notified body.

Moreover there is a strong will of the European Commission that cell phones and other portable devices are compatible with the unique battery charger.
